The Service
Tile Doctor is providing a training and marketing service which will result in leads being passed to the Client¹. Although highly qualified, Tile Doctor cannot guarantee that any lead passed to the Client will result in a sale.
Client Obligations
Upon receipt of a lead the Client must make efforts to make contact with the third party detailed. Tile Doctor does not charge for its marketing service on the understanding that the Client sources products from Tile Doctor for any services provided to the third parties; failure to do so could lead to termination of this arrangement. Further Tile Doctor reserves the right to withhold leads from the Client if it receives negative feedback from customer satisfaction surveys.
Conflict of Interests
Clients are not permitted to join other Tile Cleaning affiliates, to do so would be a Conflict of Interest resulting in termination of the agreement.
Confidentiality
The Client will not divulge to any person whatever or otherwise make use of (and shall use his best endeavour to prevent the publication or disclosure of) any trade secret or confidential information of Tile Doctor which he may be aware of during the course of the training. This clause shall not apply to any information which becomes readily available within the public domain.
Trademark
Use of the Tile Doctor® trademark can only be used following written permission from Tile Doctor Ltd, this will not normally be given until a client has completed the Tile Doctor advanced training course.
Termination
Termination of this agreement will rescind any rights of the client to use the Tile Doctor trademark or branded materials.
Indemnity
The Client shall indemnify and keep indemnified Tile Doctor against all damages, claims, losses, expenses and costs (including legal fees), arising in consequence of any third party claims due to the Clients actions in the course of performing any Services. This right of indemnity includes, without limitation, those losses which may result from the claims or suits for libel, violations of right of privacy or a proven wrong to any third party under the law of tort.
Jurisdiction
These terms shall be interpreted in accordance with English law and the parties submit to the exclusive jurisdiction of the English courts.
¹ Price and Payment
The cost of the 2 day training course is £395 (+VAT. All prices quoted are subject to VAT at the current rate.
