The Service
Tile Doctor is providing a training and marketing service which will result in leads being passed to the Client. Although highly qualified, Tile Doctor cannot guarentee that any lead passed to the Client will result in a sale.
Price and Payment
The prices stipulated are subject to VAT at the current rate.
Client Obligations
Opon receipt of a lead the Client must make efforts to make contact with the third party detailed.
Customer Satisfaction
Tile Doctor reserves the right to withold referrals to the Client if it receives negative feedback from customer satisfaction surveys.
Confidentiality
The Client will not divulge to any person whatever or otherwise make use of (and shall use his best endeavour to prevent the publication or disclosure of) any trade secret or confidential information of Tile Doctor which he may be aware of during the course of the training. This clause shall not apply to any information which becomes readily available within the public domain.
Trademark
Membership of the Tile Doctor network does not allow the Client the right to use the Tile Doctor™ trademark.
Termination
Clients may (without prejudice to any other remedy) give 7 days notice if they wish to re-arrange or cancel the agreed training date.
Indemnity
The Client shall indemnify and keep indemnified Tile Doctor against all damages, claims, losses, expenses and costs (including legal fees), arising in consequence of any third party claims due to the Clients actions in the course of performing any Services. This right of indemnity includes, without limitation, those losses which may result from the claims or suits for libel, violations of right of privacy or a proven wrong to any third party under the law of tort.
Jurisdiction
These terms shall be interpreted in accordance with English law and the parties submit to the exclusive jurisdiction of the English courts.
